1. Acceptance of Terms

By using the website northandmainjunkremoval.com ("Website") or engaging services from North & Main Repurposing + Junk Removal ("North & Main," "we," "us," or "our"), you agree to these Terms of Service. If you do not agree, please do not use our Website or services.

2. Services Description

North & Main provides junk removal, hauling, donation coordination, and recycling services in Davis County and Weber County, Utah. We remove furniture, appliances, yard waste, construction debris, and general household items. We do not remove hazardous materials including paint, gasoline, chemicals, or other dangerous substances.

3. Quotes and Pricing

Estimates: All quotes are estimates based on the information you provide. Final pricing may vary based on actual volume, item type, access difficulty, labor requirements, and disposal complexity.

Standard Pricing: Our trailer-based pricing includes $250 for a quarter trailer, $500 for a half trailer, and $1,000 for a full trailer. Single-item pickups receive custom quotes.

Payment: Payment is due upon completion of service unless other arrangements have been made in advance. We accept cash, credit cards, and electronic payments.

Price Changes: If the job scope changes significantly from the original estimate, we will notify you of any price adjustments before completing the work.

4. Scheduling and Cancellations

Scheduling: Most jobs are scheduled within the same week based on availability. We will confirm appointment times in advance.

Cancellations: You may cancel or reschedule with at least 24 hours notice without penalty. Cancellations with less than 24 hours notice may be subject to a cancellation fee.

Weather and Delays: We reserve the right to reschedule services due to inclement weather or other unforeseen circumstances.

5. Customer Responsibilities

You agree to:

Provide accurate information about items to be removed

Ensure safe access to the property and items

Remove personal belongings from items before our arrival

Be present or provide clear instructions about what should be removed

Inform us of any hazardous materials or special disposal requirements

Not include prohibited items without prior disclosure

6. Liability and Insurance

Our Coverage: We carry general liability insurance. We will exercise reasonable care when removing items and accessing your property.

Property Damage: While we take precautions to avoid damage, you should notify us immediately of any concerns. We are not liable for pre-existing damage or damage caused by conditions you failed to disclose.

Item Removal: Once items are loaded and removed from your property, they become our property for disposal, donation, or recycling. We are not responsible for items removed by mistake if you provided unclear instructions.

Limitation of Liability: Our total liability for any claims arising from our services shall not exceed the amount you paid for the service in question.

7. Donation and Disposal

We prioritize donation and recycling over landfill disposal when possible. You may request specific charities for donations, subject to their acceptance policies. We make reasonable efforts to honor these requests but cannot guarantee acceptance by any particular organization. Items that cannot be donated or recycled will be disposed of properly in accordance with local regulations.

We do not provide tax receipts for donated items. You are responsible for determining the tax-deductible value of any donations.

8. Prohibited Items

We do not remove hazardous materials including but not limited to paint, gasoline, motor oil, pesticides, chemicals, asbestos, medical waste, explosives, or other dangerous substances. If prohibited items are discovered during service, we reserve the right to refuse removal and may charge for time and labor already expended.

9. Website Use

You agree to use our Website only for lawful purposes. You may not attempt to gain unauthorized access, interfere with Website operation, or use the Website in any manner that could damage or impair it. All content on the Website is protected by intellectual property laws and may not be reproduced without our permission.

10. Indemnification

You agree to indemnify and hold harmless North & Main, its employees, and contractors from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your provision of inaccurate information.

11. Warranty Disclaimer

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE SPECIFIC RESULTS, DONATION ACCEPTANCE, OR RECYCLING OUTCOMES.

12. Dispute Resolution

These Terms are governed by the laws of the State of Utah. Any disputes will be resolved through binding arbitration in Davis County, Utah, in accordance with the rules of the American Arbitration Association.

Either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our services after changes constitutes acceptance of the revised Terms.

14. Severability
